Subject of the License Agreement 1.1 The subject of this License Agreement for software is a non-exclusive license for using of SOFTWARE transferred from VLADSTER Ltd. upon the end user. 1.2 All clauses of this agreement have a bearing on the SOFTWARE as a whole as well as on its separate components. Copyright 2.1 VLADSTER Ltd is the exclusive owner of the copyright upon this software. 2.2 As an end user you receive a license for using the SOFTWARE if you accept all clauses of the present License Agreement. 2.3 The license is given exclusively and only to you except if another additional permit is given by VLADSTER Ltd. [VD3] 3. Terms for using the SOFTWARE 3.1 You can use the SOFTWARE simultaneously only and solely on the number of computers you have received licenses for. You do not have the right to use the SOFTWARE at one and the same time on a greater number of computers. You must not keep more copies of the SOFTWARE, no matter whether they are installed or not, than the number of the licenses owned, except as a demo or evaluation version. 3.2 You can create your own databases for the programs that are part of the SOFTWARE if such a possibility is mentioned in the documentation. 3.3 You do not have the right to distribute the SOFTWARE. By distribution it is understood giving access to the SOFTWARE to third parties through the computer network, bearers or any other way or to sell or rent the SOFTWARE. The only exceptions are if you have a distributer contract with VLADSTER Inc. allowing you to do so or if you are distributing only the parts of the SOFTWARE licensed under GPL. 3.4 You are restricted in the following actions: 3.4.1 You do not have the right to decompile or disassemble the components of the SOFTWARE except the parts that are explicitly licensed under GPL. 3.4.2 You do not have the right to make any changes in the programs’ object code with the exception of those parts of the SOFTWARE that are explicitly licensed under GPL. 3.4.3 You do not have the right to grant to third parties the right of use as well as whatever other rights upon the SOFTWARE. 3.4.4 You have no right to perform any other actions, infracting the Bulgarian or international copyright laws for using of software. Terms for preserving the SOFTWARE license 4.1 For preserving the license of the products all changes in the computer configuration like: changes of the main board, hard disc, RAM, processor as well as changes in the BIOS programming should be made in accordance with the technical instructions provided by VLADSTER Ltd. In case of non-adherence to this procedure and lost of the registration, the terms for purchasing of new work place are applied. 5. Responsibilities 5.1 Any illegal use, distribution and copying of this SOFTWARE presents a crime regarding the Copyright and Related Rights Treaties and will be penalized according to the valid legislation in Republic of Bulgaria. 5.2 If you do not abide the terms of the present License Agreement, VLADSTER Ltd will immediately deprive the right for using the SOFTWARE and will terminate the guarantee and technical service. Guarantees 6.1 VLADSTER Ltd. guarantees the quality of the data on the bearers as well as the efficiency of the programs included in the SOFTWARE package, under the terms described in the documentation, the correspondence of the software components to the specifications and the correctness of the documentation. 6.2 Regarding the rest of the components, the SOFTWARE is delivered “as it is”. VLADSTER Ltd. does not guarantee that there are no errors in the software and does not bear any responsibility in the cases of occurring of damages, direct or indirect, including damages caused by possible errors in the software package. 6.3 VLADSTER Ltd gives no guarantees for the work of this software in combination with other installed software or hardware, especially with software or hardware from earlier versions. Termination 7.1 The present License Agreement operates upon installing the software and remains in force for the time you use the SOFTWARE. 7.2 If for some reason you cannot stand by the terms of the present License Agreement, you must exterminate all copies of the software, including the bearers, documentation information files and archive copies, thus terminating the action of the License Agreement. 7.3 The present License Agreement is terminated in the cases when there is another explicit Agreement between the both sides, which clauses are different than the above-mentioned ones. These clauses have priority to the clauses listed in this License Agreement.[VD7] 8. Exceptions 8.1 The above terms and conditions are valid for the entire product. An exception is made for the CORE COMPONENTS of the product.
